{"id":9004,"date":"2022-08-02T18:02:36","date_gmt":"2022-08-02T22:02:36","guid":{"rendered":"https:\/\/360mediations.com\/en\/?p=9004"},"modified":"2022-08-02T18:03:05","modified_gmt":"2022-08-02T22:03:05","slug":"being-denied-the-right-to-hear-opponents-evidence-is-justice-denied","status":"publish","type":"post","link":"https:\/\/mail.360mediations.com\/en\/being-denied-the-right-to-hear-opponents-evidence-is-justice-denied\/","title":{"rendered":"Being Denied the Right to Hear Opponent\u2019s Evidence is Justice Denied"},"content":{"rendered":"\n<p>This recent decision expands on my prior post entitled \u201c<a href=\"https:\/\/360mediations.com\/en\/cross-examination-denied-at-trial-is-likely-justice-denied\/\">Cross-Examination Denied at Trial is Likely Justice Denied<\/a>.\u201d\u00a0<\/p>\n<p>This recently released decision from the Divisional Court concerned a decision made by a tribunal (in this case the Landlord and Tenant Board), and the appellate concluded that the tribunal\u2019s decision had to be set aside because the tribunal\u2019s procedural ruling denied a party the right to hear their opponent\u2019s evidence under oath.\u00a0<\/p>\n<p>Just as I pointed out in my prior post how it was procedurally unfair to dispense with cross-examinations on key evidentiary disputes, it is also procedurally unfair to exclude a party from a hearing room when their opponent is tendering evidence.\u00a0 Indeed, how can there be effective cross-examination if a party is precluded from hearing what evidence was led by their opponent?\u00a0 How does a party know the basis upon which the decision will be made if they don\u2019t hear what the other side said?\u00a0 How does a party know what evidence to lead to counter their opponent when they don\u2019t know what their opponent said under oath or affirmation?\u00a0 Clearly, all of these shortcomings reflect why a procedural ruling excluding a party from the hearing room while evidence is being tendered by their opponent leads to justice denied, and a new hearing will be required.\u00a0<\/p>\n<p><strong><em>Carr v.
